Initial Licensure and License Renewal
When you apply for your license to practice, you will be asked a series of questions. You must answer those questions honestly, interpreting the questions simply. If the Licensing Board has any concerns about your fitness or competency to practice, they may request that you submit an explanation addressing their concerns. They may call on you to “personally appear” at a Board Meeting, and explain the situation. Such an appearance can be intimidating, as Board Meetings are public, and some boards have hundreds of attendees at each meeting.

Consumer Complaints
If your license is regulated by the Indiana Professional Licensing Agency (“IPLA”), any complaints made against you will be investigated the Office of the Indiana Attorney General. You will be notified of the complaint, and asked to respond within 20 days. Your response is critical to determining whether your complaint is dismissed, pursued further, or even if other charges may be filed against you. Iosue Law will investigate the complaint, and prepare a response for you with documentation and cohesion in an effort to protect your rights, and your license.
Administrative Complaints
If your consumer complaint is not dismissed, the Attorney General may file an Administrative Complaint before your licensing Board. If an administrative complaint is filed against you, your license and your livelihood is in jeopardy. At this point, you have two options: (1) take your case to a fact finding hearing in which the State must prove that committed misconduct, and argue for a specific sanction or restriction on your right to practice; or (2) admit your misconduct, and settle your case for an agreed sanction.
Fact-Finding Hearing
A Fact Finding Hearing is essentially a trial in which the State presents evidence against you, both documentation and by witness testimony. You have the right to an attorney at such a hearing to represent you. You have the right to cross examine witnesses, and question documentation. Having an attorney prepare your defense and appear with you at a Fact-Finding Hearing can make the difference in keeping your license, or in the sanctions imposed against you.
Settlement Agreement
There are situations in which a practitioner may want to admit misconduct, and agree to a certain sanction. However, the Board does not have to accept this agreement, and reject it. If this happens your case will essentially “go back to the drawing board” either to renegotiate a settlement to once again be presented to the Board, or to prepare for Fact-Finding Hearing. Having an attorney assist you negotiating settlement can not only affect the settlement you are offered, but whether the Board accepts it.
