Initial Licensure and License Renewal
There are many steps involved when beginning your indiana professional licensing journey. When you apply for your license to practice medicine, you will be asked a series of questions. You must answer those questions honestly, interpreting the questions simply. If the Medical Licensing Board has any concerns about your fitness or competency to practice, they may request that you submit an explanation addressing their concerns. They may call on you to “personally appear” at a Board Meeting, and explain the situation. Consumer Complaints
If your medical license is regulated by the Indiana Professional Licensing Agency (“IPLA”), any complaints made against you will be investigated the Office of the Indiana Attorney General. You will be notified of the complaint, and asked to respond within 20 days. Your response is critical to determining whether your complaint is dismissed, pursued further, or even if other charges may be filed against you. Administrative Complaints
If your consumer complaint is not dismissed, the Attorney General may file an Administrative Complaint before your licensing board. If an administrative complaint is filed against you, your license and your livelihood is in jeopardy. At this point, you have two options: (1) take your case to a fact finding hearing in which the State must prove that you committed misconduct, and argue for a specific sanction or restriction on your right to practice; or (2) admit your misconduct, and settle your case for an agreed sanction.
Fact-Finding Hearing
A Fact Finding Hearing is essentially a trial in which the State presents evidence against you, by both documentation and witness testimony. You have the right to an attorney at such a hearing. You have the right to cross examine witnesses, and question documentation. Settlement Agreement
